1. Introduction

These Terms and Conditions ("Terms") govern your use of the AITripBot mobile application ("Service", "App") operated by Sequla Limited Partnership ("we", "our", "us", "Company").

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Service.

2. Service Description

AITripBot is an AI-powered travel planning assistant that provides:

Core Features

- AI Chat Assistant: Conversational travel planning and recommendations

- Trip Planning: AI-generated itineraries with daily activities and recommendations

- Image Analysis: Photo recognition for menu translation and landmark identification

- Location Services: GPS-based weather forecasts and local recommendations

- Booking Integration: Affiliate partnerships with travel booking platforms

Third-Party Integrations

- AI Services: OpenAI (ChatGPT, GPT-4, Whisper), Google Gemini

- Maps & Location: Google Maps, Google Places, Google Weather API

- Booking Partners: Expedia (hotels, flights), Klook (activities)

- Infrastructure: Supabase (database, authentication)

3. User Accounts and Registration

We offer three tiers of service:

1. Guest Account: No registration required

2. User Account: Free Registration

3. Member Account (Premium)

Registration Requirements

- Valid email address

- Accurate personal information

- Compliance with minimum age requirements (13+ years)

- Agreement to these Terms and Privacy Policy

You are responsible for:

- Maintaining the confidentiality of your account credentials

- All activities that occur under your account

- Notifying us immediately of any unauthorized use

4. Credit System and Usage Limits

- Our Service operates on a credit-based system

- Each account type—Guest, User, and Member—has a different daily credit limit.

- Credits reset daily at midnight UTC. Unused credits do not carry over to the next day.

5. Acceptable Use Policy

You may use our Service for:

- Personal travel planning and research

- Legitimate travel-related inquiries

- Educational purposes related to travel and destinations

You may NOT use our Service for:

- Commercial purposes without written permission

- Generating content that violates laws or regulations

- Harassment, abuse, or harmful content

- Attempting to reverse engineer or hack the Service

- Sharing inappropriate, offensive, or illegal content

- Spam or automated requests that exceed reasonable usage

When using our AI features, you agree not to:

- Upload images containing personal identification documents

- Share private or confidential information

- Request assistance with illegal activities

- Generate content that infringes on intellectual property rights

6. AI Services and Accuracy

Our Service uses artificial intelligence to provide travel recommendations and information. You acknowledge that:

- AI responses are generated based on training data and may not always be accurate

- Travel information may change frequently and should be verified

- We do not guarantee the accuracy of AI-generated itineraries or recommendations

- Local conditions, prices, and availability may differ from AI suggestions

You are responsible for:

- Verifying all travel information before making decisions

- Checking current visa, health, and safety requirements

- Confirming business hours, prices, and availability

- Using common sense and exercising caution when traveling

7. Location Services and Privacy

With your permission, we collect location data to:

- Provide weather forecasts for your area

- Suggest nearby restaurants and attractions

- Enhance travel recommendations with local context

- Improve Service functionality

Location Privacy

- You can disable location services in your device settings

- When location is disabled, we may use IP-based location detection

- Location data is used only for Service functionality, not for advertising

- We do not sell or share your location data with third parties

8. Booking and Affiliate Services

Our Service includes links to third-party booking platforms and other service providers

We may earn commissions from bookings made through our affiliate links. This does not affect:

- The price you pay for services

- The quality of our recommendations

- Our commitment to providing unbiased travel advice

We are not responsible for:

- The quality or availability of third-party services

- Booking confirmations or cancellations

- Customer service issues with booking partners

- Refunds or disputes with third-party providers

9. Intellectual Property

We own or license all intellectual property in the Service, including:

- The AITripBot application and its features

- AI-generated content and recommendations

- User interface design and functionality

- Trademarks, logos, and branding

You retain ownership of content you provide to the Service, but grant us a license to:

- Process your messages and images for AI analysis

- Store data necessary for Service functionality

- Improve our AI models and Service quality (anonymized data only)

Third-Party Content

10. Data Storage and Retention

Most user data is stored locally on your device:

- Chat history and conversations

- Trip itineraries and plans

- User preferences and settings

- Cached images and data

We store minimal data on our servers:

- Account information (registered users only)

- Usage analytics (anonymized)

- Service performance metrics

- Error logs and diagnostic data

Data Retention

- Local data: Controlled by you, deleted when you uninstall the app

11. Payment Terms (Premium Features)

Member accounts may include premium features subject to:

- Weekly, Monthly or annual subscription fees

- Automatic renewal unless cancelled

- Refund policies as outlined in app store terms

Payments are processed through:

- Apple App Store (iOS users)

- Google Play Store (Android users)

- Third-party payment processors

NO REFUNDS POLICY: All payments for premium features, subscriptions, and services are final and non-refundable. We do not provide refunds, credits, or exchanges for any reason, including but not limited to:

- Dissatisfaction with the Service

- Unused credits or subscription time

- Technical issues or service interruptions

- Account termination or suspension

- Changes to features or pricing

- Accidental purchases

12. Service Availability and Modifications

Service Availability: We strive to provide continuous service but do not guarantee:

- Uninterrupted access to the Service

- Error-free operation at all times

- Compatibility with all devices or operating systems

- Availability in all geographic regions

Service Modifications: We reserve the right to:

- Modify or discontinue features with reasonable notice

- Update these Terms as necessary

- Change credit limits or pricing structures

- Implement new features or remove existing ones

13. Limitation of Liability

Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied.

Limitation of Damages: To the maximum extent permitted by law, we shall not be liable for:

- Loss of profits, data, or business opportunities

Maximum Liability:

Our total liability to you for all claims shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

14. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from:

- Your use of the Service

- Your violation of these Terms

- Your violation of any third-party rights

- Content you provide to the Service

15. Termination

You may terminate your account at any time by:

- Uninstalling the application

- Ceasing to use the Service

We reserve the right to terminate, suspend, or ban your account immediately and at our sole discretion for:

- Violation of these Terms

- Fraudulent or illegal activity

- Abuse of the Service or other users

- Misuse of the Service as determined by us

- Suspicious or harmful activity

- Any behavior we deem inappropriate or harmful to our Service or community

- Any reason we determine necessary to protect our Service, users, or business interests

We may exercise this right without prior notice and without providing specific reasons for the termination. Our decision to terminate or ban an account is final and at our complete discretion.

Upon termination:

- Your access to the Service will cease

- Local data may remain on your device

- Server data will be handled per our Privacy Policy

- These Terms will remain in effect for applicable provisions
